These Terms & Conditions (βTermsβ) govern all sales, transactions, and use of this website operated by Maharashtra Traders, Mumbai (βSellerβ, βWeβ, βUsβ).
By accessing this website, placing an order, or making payment, the customer (βBuyerβ, βYouβ) agrees to be legally bound by these Terms.
1. Final Sale Policy
All Sales Are Final
All sales are FINAL.
No exchange, return, cancellation, refund, replacement, or warranty shall be applicable under any circumstances unless explicitly agreed in writing by the Seller prior to payment.

2. Advance Payment & Non-Refundability
100% Advance Payment Mandatory
All orders require 100% advance payment.
Once payment is made, it is strictly non-refundable, irrespective of dispatch status, order cancellation requests, delays, price fluctuations, or any other reason.

3. No Cash / Bank Refunds
Refunds Not Permitted in Any Mode
No cash, UPI, cheque, or bank transfer refunds are permitted under any circumstances.
If any adjustment is approved in writing by the Seller, it shall be issued only as a credit note, usable against future purchases and subject to Seller discretion.
4. Product Images, Videos & Specifications Disclaimer
Indicative Representation Only
All product images, videos, descriptions, specifications, dimensions, colours, weights, packaging, and technical details displayed on the website or shared through any medium are indicative only.
Actual products may vary due to manufacturer changes, batch variations, upgrades, or supply conditions without affecting core functionality.

5. Dispatch, Transit & Risk
Transfer of Risk to Buyer
All goods travel entirely at the Buyerβs risk.
Risk of loss, damage, theft, delay, or deterioration transfers to the Buyer immediately upon dispatch or handover to the transporter or courier.
Buyer Responsibility
Safe unloading, handling, storage, installation, and usage are solely the Buyerβs responsibility.

6. No Claims After Dispatch
Post-Dispatch Claims Not Accepted
No claims, complaints, replacements, or disputes shall be accepted after dispatch of goods, including transit damage or missing items.

7. Used / Demo / Open / Non-Packed Goods
βAS IS β WHERE ISβ Sale Condition
Products sold as used, demo, display, open-box, or without original packaging are sold strictly on an βAS IS β WHERE ISβ basis.
Such products carry no warranty, no return, and no replacement, and the Buyer accepts the condition at the time of purchase.
8. Warranty Disclaimer
No Warranty Unless Expressly Stated
Unless expressly stated in writing, the Seller provides no warranty.
Any manufacturer warranty, if applicable, shall be governed solely by the manufacturerβs terms.
Warranty Void Conditions
Improper installation, misuse, alteration, or non-recommended application shall void all Seller responsibility.
9. Government Subsidy Disclaimer
Subsidy Approval Not Guaranteed
Any government subsidy, scheme, or benefit is subject to approval by the concerned authority.
The Seller shall not be responsible for eligibility, documentation, approval, rejection, delay, or non-receipt of any subsidy.
No refund or compensation shall arise due to subsidy-related issues.
10. Intended Use & Misuse
Permitted Product Usage
Products are intended for agricultural and/or industrial use only.
Any misuse, overloading, improper operation, unauthorized modification, or application beyond manufacturer recommendations shall void all Seller liability.
11. Pricing & Specification Changes
Right to Modify Pricing and Details
Product prices, specifications, availability, taxes, and freight charges are subject to change without prior notice.
Orders shall be billed at the price applicable at the time of payment confirmation.
12. Limitation of Liability
Maximum Liability Cap
The Sellerβs total liability, if any, shall be strictly limited to the invoice value of the product supplied.
Exclusion of Indirect Losses
The Seller shall not be liable for any indirect, incidental, consequential, or business losses including loss of profit, crop loss, or downtime.
13. Intellectual Property Rights
Ownership of Website Content
All content on this website, including text, images, videos, logos, and branding, is the intellectual property of Maharashtra Traders and shall not be copied, reproduced, or used without written permission.
14. Governing Law & Jurisdiction
Applicable Law
These Terms shall be governed by the laws of India.
Jurisdiction
All disputes shall be subject to the exclusive jurisdiction of courts in Mumbai, Maharashtra.
15. Acceptance of Terms & Conditions
Binding Acceptance
Placing an order, making payment, or accepting delivery constitutes full, unconditional, and legally binding acceptance of these Terms & Conditions.
Consumer Protection Act Compliance & Legal Clarification
This section is issued in accordance with the Consumer Protection Act, 2019 and applicable Indian commercial laws, to ensure full transparency and prevent misinterpretation of rights, obligations, and liabilities.
Nature of Business & Buyer Classification
Maharashtra Traders primarily operates as a business-to-business (B2B) supplier of agricultural and industrial equipment.
Purchases made for commercial, agricultural, resale, rental, or income-generating purposes do not qualify as βconsumer purchasesβ under the Consumer Protection Act, 2019.
Buyer Declaration
- The Buyer confirms that the purchase is not for personal household consumption.
- The Buyer acknowledges technical understanding or access to expert guidance.
- The Buyer accepts responsibility for product selection and application.
No Unfair Trade Practice
All product pricing, specifications, limitations, exclusions, and policies are clearly disclosed prior to payment.
The Seller does not engage in misleading advertisements, false representations, or hidden conditions.
No Deficiency of Service
Dispatch of goods as per confirmed order constitutes completion of Sellerβs obligation.
Post-dispatch issues including transit damage, misuse, improper installation, or third-party transporter delays do not constitute βdeficiency of serviceβ under the Consumer Protection Act.
Informed Consent & Voluntary Acceptance
The Buyer confirms having read, understood, and voluntarily accepted:

Acceptance is deemed complete upon payment, invoice issuance, or delivery acceptance, whichever occurs earlier.
Exclusion of Consumer Forum Claims

Any dispute shall be resolved strictly under contract law and commercial laws applicable in India.
Technical Products β Limitation of Expectation
Agricultural machinery and industrial equipment require proper knowledge, conditions, and maintenance.
Performance may vary based on:
- Operating conditions
- User skill and handling
- Maintenance practices
- Load, terrain, and environment
Such variations do not constitute defect, deficiency, or misrepresentation.
Consumer complaints based on change of mind, non-usage, expectation mismatch, or third-party transporter issues are expressly excluded.
Burden of Proof
In any legal or quasi-legal proceeding, the burden of proof regarding defect, misrepresentation, or deficiency shall lie solely with the Buyer.
Seller Protection Clause
The Seller shall not be liable for:

- Loss of crop, income, or productivity
- Downtime or operational delays
- Acts of transporter, courier, or third parties
Statutory Disclaimer
